These Terms of Service constitute a legally binding agreement between Scholar Architecture ("Service Provider") and the individual utilizing our services ("Service Receiver" or "Client").
1. Purpose of Agreement & Program Scope
The purpose of this framework is to establish a structured professional relationship under which Scholar Architecture assists the Client in pursuing international higher education opportunities, including but not limited to:
- Fully funded Masters and PhD opportunities abroad
- Research Assistantships and Teaching Assistantships
- Government scholarships, university fellowships, and tuition waivers
- Strategic academic profile development and international research collaborations
- Professor outreach, application execution, and visa guidance
This agreement governs all operational, advisory, documentation, and execution matters associated with the Elite Program.
2. Nature of Service
The Client explicitly acknowledges that the Elite Program is a strategic consultancy and academic positioning service designed to optimize applications. It is NOT an admission-selling, visa-selling, or unconditional outcome-guarantee service.
All final admissions, scholarship funding, and visa approval decisions are made exclusively by third-party universities, independent funding bodies, and respective embassy immigration authorities. The estimated engagement duration is 8 to 12 months.
3. Client Responsibilities
The success of the application positioning depends on active collaboration. The Client agrees to:
- Provide completely truthful, accurate, and plagiarism-free academic transcripts, credentials, and portfolios.
- Actively participate in the preparation process and attend scheduled advisor strategy meetings.
- Respond to edits and reviews within 3 working days. Delays beyond this window will be considered as approval of the drafts to meet institutional application deadlines.
- Maintain polite and professional communication with advisors, outreach staff, and editors.
- Comply with target list choices and strategic advisor suggestions.
4. Inactivity & Communication Policy
Timelines are critical in academic intakes. To maintain quality of service, the following policies are enforced:
- Service Pause: Enforced if the Client shows no active response or contact for 20 working days.
- Service Suspension: Enforced if the Client shows no active response or contact for 40 working days.
Scholar Architecture is not responsible for missed deadlines or lost scholarship opportunities resulting from Client inactivity.
5. Limitation of Expectation & Liability
Scholar Architecture does not guarantee admission placements, funding availability, supervisor responses, or visa outcomes, as these depend on independent admissions boards and immigration officers.
Scholar Architecture shall not be held liable for any rejections, visa refusals, changes in international university policies, geopolitical disruptions, or financial/emotional losses. Under all circumstances, the maximum liability is limited to the total fees paid by the client.
6. Intellectual Property Rights
All documents, target sheets, strategic email templates, publication guidelines, and advisory portals remain the intellectual property of Scholar Architecture. Unauthorized copying, distribution, or resale is strictly prohibited.
7. Legal Validity, Force Majeure & Governing Law
Validity: This agreement and its terms are accepted and active upon enrollment, initial payment, or signing of the program service agreement.
Force Majeure: Neither party is responsible for delays or failure of execution due to natural disasters, pandemics, war, or abrupt geopolitical policy changes.
Governing Law: These terms are governed exclusively by the laws of Bangladesh. Any legal proceedings shall be handled in Dhaka courts.
